Loss of nationality/Renunciation of nationality

Loss of Nationality

According to the Nationality Act of the Republic of Korea, a person who is a national of the Republic of Korea and voluntarily acquires foreign nationality loses their nationality of the Republic of Korea at the time of acquiring that foreign nationality (Article 15). A person who has lost their nationality must report the loss of nationality to the Minister of Justice (Article 16).

Renunciation of Nationality

According to the Nationality Act of the Republic of Korea, a multiple national who has acquired both Korean and foreign nationalities through birth or other means may report their intention to choose foreign nationality to the Minister of Justice through the overseas mission having jurisdiction over their address (Article 14). A child born to one parent who holds Korean nationality acquires Korean nationality regardless of whether their birth is reported in Korea.

In the case of a male with multiple nationalities, renunciation of nationality can be reported within three months from the time he is classified as a conscription-eligible person according to Article 8 of the Military Service Act, from birth (until March 31 of the year he turns 18). For example, those born in 2009 must report by March 31, 2027.
